Dealix Corporation (“Dealix”) owns and operates a Web-based service for car buyers known as the Dealix New Car Buying Service. This process is being syndicated here as the WomanMotorist.com New Car Buying Service. Regardless of syndication status, the process is referred to throughout this document as the "Dealix New Car Buying Service".
What "InvoiceDealers" Does And Does Not Mean
INVOICEDEALERS IS A TRADEMARK ONLY, AND DOES NOT IMPLY THAT ANY DEALER DOING
BUSINESS WITH EITHER DEALIX OR A PARTNER OF DEALIX CAN OR WILL OFFER ANY VEHICLE
TO ANY CUSTOMER AT “INVOICE” PRICE, “BELOW MARKET” PRICE, OR AT ANY SPECIFIED
PRICE. All prices quoted, whether immediately or upon customer contact, and
whether through a Dealix Certified Dealer or a Dealix Trusted Partner-affiliated
dealer, are at the sole discretion of the selling franchised car dealer.
What "Invoice" Does And Does Not Mean
"Invoice" and "Dealer Invoice" DO NOT REFLECT THE FINAL COST OF THE VEHICLE TO
THE DEALER. When used anywhere within the Dealix New Car Buying Service, they
are useful solely, and intended solely, as a publicly available and agreed-upon
COMPARATIVE TOOL with which different dealers' pricing can be fairly evaluated.
As a result, Dealix New Car Buying Service process listings DO NOT INDICATE OR
PRESUME TO INDICATE that any vehicle cost any listed dealer any specific amount.
It is Dealix’s intent and policy to be in good-faith compliance with
state laws regulating automotive advertising. Therefore, "invoice-based"
advertising is NOT AVAILABLE to dealers in restricted states.
The Dealix
New Car Buying Service is a marketing service for automotive dealerships who
may optionally select to offer fixed, up-front pricing to WomanMotorist.com
shoppers. Due to the rapidly changing nature of the auto retailing environment,
dealer agreements with Dealix, if any, are considered temporary and non-binding
on the dealer, DO NOT ALWAYS COVER ALL MODELS, AND ARE SUBJECT TO CHANGE OR
REVOCATION WITHOUT NOTICE AT ANY TIME. Dealix and WomanMotorist.com have no
control over whether or not a vehicle will be available at all, or will be made
available by any listed dealer at the listed price at any given time. Although
every effort is made to keep the listings current, Dealix takes no
responsibility for outdated or superceded information found in the Dealix New
Car Buying Service.
Trusted Partner Buying Service Terms And Conditions
The following section applies only to Dealix Trusted Partners, and does not
pertain to relationships established directly with new car dealerships referred
to as Dealix Certified Dealers.
Dealix partners with certain other
Internet car buying services, Dealix Trusted Partners, to serve the needs of the
WomanMotorist.com visitors who cannot be accommodated by a Dealix Certified
Dealer. A disclosure of this relationship, as well as a clear link to the terms
and conditions of the relevant Trusted Partner(s), is provided before the
customer provides any personal information. These terms and conditions govern
the customer’s interaction with and use of the Trusted Partner’s systems and
services. Customers not agreeing to the Trusted Partner’s terms and conditions
should not proceed beyond the page containing the link.
Customers who
submit information through the Dealix New Car Buying Service to a Dealix Trusted
Partner become the customer of that partner. The Trusted Partner is responsible
for handling all aspects of follow-up and service with the customer following
the customer’s exit from the Dealix New Car Buying Service. The business
model(s) of the Trusted Partner shall prevail in all of its contacts with the
customer.
The Buyer's Responsibilities
The following section applies only to the Dealix New Car Buying Service and it's
Certified Dealers, and does not pertain to other Dealix Channels or properties,
including but not limited to the Dealix Trusted Partners and their respective
Internet car buying services.
Any prospective buyer considering the
purchase of a vehicle from one of the sources listed on the Dealix New Car
Buying Service is solely responsible for the transaction, and Dealix expressly
disclaims any and all liability or responsibility whatsoever for the success or
suitability of any business dealing. Final assessment of the fitness of the
dealership for the buyer's business, the determination, fairness and accuracy of
the purchase price, and the task of seeing the purchase through to its
successful conclusion, is solely the buyer's responsibility.
Although
every effort is made to insure correct information in the listings, the buyer
should treat all data as preliminary and subject to change without notice, and
must verify the data through independent contact of the dealership(s) in
question.
Membership and listing pricing and terms are subject to change
without notice.
Dealix Is Not A Broker Or An Agent
Dealix does not function as a buyer's or seller's agent in any way, is not
compensated based on a dealer's success or failure in consummating any
transaction, and does not represent any party in any transaction. The Dealix New
Car Buying Service is solely a marketing and referral service which pairs
interested buyers with sellers which MAY meet the buyer's conditions. Use of the
Dealix New Car Buying Service, either as a buyer or a seller, indicates your
understanding of and consent to these conditions.
Execution In Good Faith
In all jurisdictions in which its business has effect, Dealix endeavors to
comply in good faith with applicable rules and regulations. Due to the expansive
nature of the Internet, it is not possible to be fully aware of all existing
regulations which may affect the execution of the business related to the Dealix
